“Mediating disputes by smoothing away discords” is a traditional way China has always used to solve civil disputes. However, we see that with the building of a modern legal system western style, after the age of Mao, the prominence of mediation declines. Attitudes towards mediation become negative.

Contracts were concluded in China already before the creation of the early Chinese writing, more than 3000 years ago. But until the 20th century, until the last days of the Qing dynasty, there were no Laws on contracts.
